The Bennett Brook Disability Justice Centre (DJC) is a declared place under the Declared Places (Mentally Impaired Accused) Act 2015 (WA). The DJC falls under the portfolio of the Minister for Disability Services and is operated by the Department of Communities.
Residents of the DJC have a primary diagnosis of disability (Cognitive Impairment, Intellectual Disability or Autism), usually with complex needs, and have been charged with an offence and found to be unfit to stand trial or acquitted by reason of unsoundness of mind. Some residents may also have psychiatric symptoms and complex behavioural disturbances secondary to their intellectual disability and may require input into their overall management from psychiatric services.
Part 10 of the Declared Places Act establishes the role, functions and powers of Mental Health Advocates relating to residents of the DJC. This also includes the requirement to provide a report to the Minister on the activities of all Advocates during the year, which is to be tabled in Parliament by the Minister.
