Proposed Changes to the Pilbara, GSI and ESM Regulations

Energy Policy WA has finalised proposed changes to the Electricity Industry (Pilbara Networks) Regulations 2021, Gas Services Information (GSI) Regulations 2012 and Electricity Industry (Electricity System and Market) Regulations 2004.

Energy Policy WA published a Consultation Paper outlining proposed changes to the Electricity Industry (Pilbara Networks) Regulations 2021(Pilbara Regulations), Gas Services Information (GSI) Regulations 2012 (GSI Regulations) and Electricity Industry (Electricity System and Market) Regulations 2004 (ESM Regulations). 

The proposed changes included:  

  • Reintroducing temporary rule-making powers to the Pilbara and GSI Regulations so that the Minister for Energy can make, amend or repeal individual Pilbara Networks Rules and GSI Rules, time-limited to 31 October 2027; 
  • New Category C civil penalty provisions in the ESM Regulations; 
  • Amendments to the immunity provisions in the ESM Regulations so that delegates of AEMO are covered by limited liability, up to the prescribed amount.
