New process to deal with disputes over departmental decisions

A new dispute resolution process has been established to assist people in regard to decisions or actions by the Department of Agriculture.
Primary Industry Minister Monty House said the Primary Industry appeals committee would focus on achieving a mutually acceptable outcome to the dispute.
Mr House said disputes arose occasionally as the department administered legislation and regulations on complex agricultural issues.
"I believe this initiative breaks new ground in conflict resolution and I am confident farmers, primary industry operators and the department will benefit from this streamlined process," he said.
The Minister has appointed John Negus as an independent chairman of the appeals committee.
Mr Negus has had extensive experience in dispute resolution as a former Commissioner of the Western Australian Industrial Relations Commission.
The committee of three will also include nominees from a relevant farm organisation and the department to ensure expertise that is appropriate to the particular dispute and subject.
"If a party feels aggrieved by a Department of Agriculture decision, the appeal process is initiated by a written request to the Minister and submissions are made by the appellant, the department and any other relevant party," Mr House said.
"Then, after a formal hearing and consideration by the committee, the chairman makes a recommendation to the Minister either to endorse the agreed resolution or make a final decision on the appeal.
"However, if a mutal solution proves impossible, the committee will then advise the Minister of its recommendations regarding a decision to settle the appeal."
Mr House said hearings would usually take place in Perth but regional meetings would be used to speed up the resolution process.
