The High Court of Australia today handed down its decision in the case of the South Bronzewing mining tenement dispute.
The High Court has upheld the appeal brought by Hot Holdings Pty Ltd against the August 2000 decision of the Full Court of the Supreme Court.
The High Court's decision reverses the Full Court's findings that there was 'a reasonable apprehension of bias' in relation to the former Minister's decision of August 10, 1998 to grant the exploration licence to Hot Holdings Pty Ltd by reason of the Minister unwittingly acting on tainted advice.
This means the original decision of the former Minister stands.
