Statement from Agriculture and Food Minister Alannah MacTiernan
"I note comments today and last night from WAFarmers and Livestock Shipping Services (LSS) regarding the Maysora inspection and believe it is important to get the facts straight.
"LSS has claimed that no attempt was made to stop a Department of Primary Industries and Regional Development animal welfare inspection of the Maysora.
"This is false. The department sought consent in advance to board the Maysora to carry out an animal welfare inspection. Consent was not granted.
"A warrant was then obtained and presented to LSS, who then co-operated with the inspection.
"WAFarmers claim that State inspectors did not act on their concerns. This is also false.
"A Livestock Management Advice was provided verbally to LSS's managing director outlining the concerns of the inspectors at the time. These were acknowledged by the exporter, who said these would be considered and acted on.
"Inspectors took photographic and video evidence on board the vessel that support the findings of their report.
"We also note that the independent vet appointed by the Federal Government did not participate in the State Government inspection.
"There were legal questions at the time as to whether the WA Animal Welfare Act 2002 could allow for the ship to be prevented from departing.
"Since the inspection we have received legal advice from the State Solicitor that suggests ships could be stopped under State law if there is real risk of harm to animals.
"The findings of the inspection report from the Maysora remain a serious cause for concern; we await a formal response from the Federal Government to these concerns.
"We would urge industry to face up to their current situation; confidence in live export is at an all-time low, and real steps must be taken to restore that confidence.
"In the meantime, the WA Government will continue to exercise its powers under the State Animal Welfare Act to ensure decent treatment of livestock.
"It should be noted that WA inspectors have subsequently received consent to board the Wellard ship Ocean Drover, and an inspection found no significant issues on board."
