The Petroleum Legislation Amendment Act 2024 (PLAA24) amended the Petroleum and Geothermal Energy Act 1967 (PGERA67) and the Petroleum (Submerged Lands) Act 1982 (PSLA82) to, amongst other things, provide a legislative framework for the pipeline transport and permanent underground storage of greenhouse gas substances. These activities form part of what is commonly referred to as Carbon Capture and Storage (CCS).
The draft Petroleum, Geothermal Energy and Greenhouse Gas Storage (Greenhouse Gas Injection and Storage) Regulations 2025 and the Petroleum and Greenhouse Gas Storage (Submerged Lands)(Greenhouse Gas Injection and Storage) Regulations 2025 (GHG Regulations), were published for public comment in July 2025.
The draft GHG Regulations relate specifically to certain matters for permanent underground storage of greenhouse gas substances and will sit alongside other subsidiary regulations made under PGERA67 and the PSLA82.
The submissions have now been published. The review process notified respondents that their submissions would be made publicly available on the department’s website. For the purposes of grouping and responding to feedback from stakeholders more efficiently, the submissions have been arranged by theme. Feedback submissions are included verbatim.
