Applications and instruments for the surrender of a title, a site closing certificate for an identified greenhouse gas storage formation, and consent to conduct a scientific investigation.

These forms are approved under the Petroleum, Geothermal Energy and Greenhouse Gas Storage Act 1967 (PGEGGSA), Petroleum and Greenhouse Gas Storage (Submerged Lands) Act 1982 (PGGS(SL)A) and the Petroleum and Greenhouse Gas Pipelines Act 1969 (PGGPA) (together, the Acts).

Under the Acts, titleholders may apply to the Minister for the full or partial surrender of a title. Should the Minister provide their consent to the surrender of a title, a titleholder must then lodge a registerable surrender instrument with the department. Only once the registerable surrender instrument is received and notice of the surrender gazetted in the Western Australian Government Gazette is the surrender of a title given effect.

An application for the surrender of a title must be made using the approved form (found below) and submitted in the Petroleum and Geothermal Register (PGR). There is no fee to apply for the surrender of a title.

The department will inform the titleholder(s) applying to surrender their title should the Minister provide their consent to the surrender. At that point, the titleholder(s) can complete and lodge the relevant registerable surrender instrument. The instrument for completion can be found below.

Scientific investigations

Under section 116 of the PGEGGSA and section 123 of the PGGS(SL)A, the Minister may, upon an application of a person, consent in writing to the carrying on in Western Australia by any person of exploration operations in the course of scientific investigation.

An application for the consent to conduct a scientific investigation must be made using the approved form (found below) and submitted in PGR. There is no fee to apply for the consent to conduct a scientific investigation.

Site closing certificates

Under section 69HE of the PGEGGSA and section 74AM of the PGGS(SL)A, a greenhouse gas (GHG) licensee may apply to the Minister for a site closing certificate in relation to a particular identified GHG storage formation specified in the GHG injection licence.

An application for a site closing certificate is required in the following circumstances:

  • if GHG injection operations have ceased; or
  • if directed to do so due to:
    • a ground existing for the termination or cancellation of the GHG injection licence; or
    • the GHG injection licence being tied to a ceased petroleum lease or licence.
