What to include in your appeal

To be valid, your appeal must:

  • Be in writing and signed (if submitted by post or hand-delivered). Online lodgement preferred.
  • Be addressed to the Minister for the Environment (unless it is submitted via the online form).
  • Clearly state your grounds of appeal (preferably numbered and with supporting facts and evidence).
  • Explain what the original decision was and what part of it is being appealed.
  • Set out the specific information required in regulation 7(1)(b) of the Environmental Protection Regulations 1987.
  • Include your name and address for service of notices.
  • Be lodged within the required timeframe.
  • Be accompanied by the applicable fee.

Fees and payment

Most appeals require a fee.

You can pay:

  • Online via BPoint (preferred)
  • By Visa or Mastercard
  • By cash or money order (in person only).

If you want the fee waived, reduced, or refunded, you need to write to the Minister through the Office of the Appeals Convenor and explain why. 

Deadlines

Appeals must be lodged within the statutory timeframe. Late appeals cannot be accepted.

  • Online or by email: Until midnight on the closing date
  • Post or hand-delivered: Until 4:30pm on the closing date
  • If the deadline falls on a weekend or public holiday, then it is extended to the next business day.
