Where a commercial discovery of petroleum or geothermal energy is made, explorers have a statutory right to the grant of a petroleum or geothermal energy Production Licence. These licences are granted for an indefinite term and may be subject to termination if no operations for the recovery of the resource under the licence (either petroleum or geothermal energy) has been undertaken during a continuous period of five years.
Under the Petroleum, Geothermal Energy and Greenhouse Gas Storage Act 1967 (PGEGGSA) and the Petroleum and Greenhouse Gas Storage (Submerged Lands) Act 1982 (PGGS(SL)A), Production Licences provide holders with rights to carry out operations for the recovery of petroleum or geothermal energy within the licence area, in accordance with an approved Field Management Plan and other secondary work approvals.
