A building surveyor has returned to the State Administrative Tribunal (SAT) after failing to complete two units of study required by orders for a previous disciplinary matter.

In March 2023, Matthew James Deal (BSP370) and his company were fined $15,000 at the SAT for negligent and misleading conduct while carrying out building surveying services.

The SAT orders also required Mr Deal to complete two online study units – on inspection procedures and built environment communication and skills – by 31 December 2024. Mr Deal did not complete or enrol in the units by that date.

Failure to comply with a SAT order is a disciplinary matter under the Building Services (Registration) Act 2011.

On 23 October 2025, the SAT ordered Mr Deal to pay a fine of $8,000 and complete the units by specified dates.

The Department of Local Government, Industry Regulation and Safety’s Building and Energy division represented the Building Services Board in the proceedings.

Building and Energy Executive Director Daniel Kearney said building service providers should view disciplinary matters as a chance to learn and improve.

“It is disappointing that this practitioner has not taken the opportunity to complete relevant additional study,” Mr Kearney said.

“Because of building surveyors’ key role in the building approval process, they must carry out their work to the high standards expected of them and set out in the Code of Conduct.”
