These updates will:

  • Affect how quarterly returns are submitted.
  • Assist with determining eligibility of supervisors.
  • Affect how workers make claims and how employers approve those claims. 
  • Affect how employers make a recovery claim for Long Service Leave paid direct to workers. 

Return Reporting for Workers Entitled to Paid Leave

Return reporting for workers who are entitled to paid annual leave under our legislation has been reviewed, and an updated position has been adopted by the MyLeave Board.

For returns submitted for the January to March 2023 period onward, the ordinary pay reported for your employees who are entitled to paid annual leave under their terms of employment (including contracts of employment) should be:

  • Their daily rate of pay while on paid annual leave (inclusive of allowances that are paid while on annual leave and excluding leave loading) multiplied by;
  • The number of days of service you are reporting for them. 

Supervisor Eligibility Clarifications

Changes to the MyLeave Regulations were communicated to industry on 29 November 2021 and 28 March 2022, since then, eligibility queries regarding different cohorts of supervisors have been raised.

Eligibility is assessed on the substantial duties of the Worker aligning with a classification of work under a Prescribed Award, not the Workers job title. 

Supervisors whose time is predominantly spent on-site overseeing construction work and who's duties align to that of a Foreman would usually be eligible for MyLeave. 

Supervisors whose time is predominantly spent off-site and who's duties more align to that of a Manager or Project Manager would not usually be eligible for MyLeave.

Electronic Long Service Leave Claims

As part of our journey towards providing improved systems and services to our stakeholders, we are in the final stages of developing a user-friendly electronic claim lodgement form for worker claims and employer recovery claims.

The forms do not require printing or scanning and have built-in workflow which takes the form from worker, to employer, to MyLeave upon completion without manual intervention.
