A Perth tradesman has been fined $6,500 after pleading guilty to falsely presenting as a registered painting contractor, undertaking to carry out painting work without the required registration and failing to comply with a building remedy order. 

At Mandurah Magistrates Court on 29 September 2023, Danny James Shepherd was convicted of three offences under two building laws following prosecution by Building and Energy.

The court was told a Dwellingup homeowner engaged Mr Shepherd for painting work valued at $6,000. The quote included cleaning, preparing and painting external boards, trims, doors and frames.

The quote also included Mr Shepherd’s former painting contractor registration number, which had expired in 2017. 

Under the Building Services (Registration) Act 2011, only registered painting contractors can carry out paid painting work valued at $1,000 or more. 

The homeowner later lodged a building service complaint with Building and Energy. A remedy order was issued requiring Mr Shepherd to rectify defects including unprepared or unpainted areas and to apply the agreed number of coats to achieve an even finish.

Mr Shepherd did not comply with this order, and it was converted to a $12,375 payment order for the homeowners. Failing to remedy the defects in the initial building remedy order is an offence under the Building Services (Complaint Resolution and Administration) Act 2011

Mr Shepherd was fined $6,500 and ordered to pay $405.30 in costs.

Building and Energy encourages homeowners to carry out a licence search or check the Register of Painters before engaging someone for painting jobs valued at $1,000 or more.
