Temporary Act of Grace Employer Refunds for Prior Payments

MyLeave acknowledges some employers made direct LSL payments expecting refunds. Following review, eligible claims will be considered as Act of Grace Payments, subject to conditions and Ministerial approval. Applications close 30 April 2026.

MyLeave recognises that some employers made direct payments to workers expecting to receive a refund, based on previous understandings of how the Long Service Leave Act 1958 (LSL Act) applied.

After a review, MyLeave will now consider these refunds as Act of Grace Payments under State legislation (processed by the Minister for Industrial Relations), if specific conditions are met.

Who is eligible?

A refund may be considered where:

  • The employer made the payment on or before 12 November 2025
  • A refund application is submitted by 30 April 2026
  • The payment complied with the LSL Act, meaning the worker was entitled to long service leave through either:
    • 10 years of continuous service, or
    • 7 years of continuous service upon termination

Important information

  • MyLeave cannot process refunds if the worker did not meet the Long Service Leave Act entitlement requirements at the time the payment was made.
  • Act of Grace Payments require Ministerial approval, so applications will be processed in batches and may take longer than standard refunds.
