Failure to comply with a building remedy order is illegal and unacceptable, WA’s Building Commissioner has warned following the prosecution of a decking installer.
At Perth Magistrates Court on 4 February 2026, Azad Satpathy of Expert Decking and Tiling (WA) was ordered to pay $7,200 in fines and $1,000 costs after pleading guilty to two offences under WA’s building complaints laws.
The court heard the Building Commissioner issued two building remedy orders in 2023 requiring Mr Satpathy to rectify defective decking work at properties in Treeby and Currambine.
The matters were investigated after the homeowners lodged building service complaints with the Department of Local Government, Industry Regulation and Safety’s Building and Energy division.
Mr Satpathy never carried out the required work. The remedy orders were later converted to payment orders.
Building Commissioner Phil Payne said building service providers who do not uphold their responsibilities will be held to account.
“It is unacceptable to provide defective work in the first place as well as showing a blatant disregard for the opportunity to make it right,” Mr Payne said.
“This case should remind industry that they are legally required to comply with a building remedy order and will face consequences if they disregard this.”
