Common Use Arrangement (CUA) buyers guide for public authorities purchasing agricultural products from CUA AGR2019.

This CUA is for the supply of agricultural products across Western Australia. It is non-mandatory for use by approved users located in Western Australia.

This CUA compromises four categories:

  • Category 1: Agricultural Chemicals 
  • Category 2: Fertilisers
  • Category 3: Fencing Products
  • Category 4: General Agricultural Merchandise

Metro and Regional

This CUA is non-mandatory state-wide for State agencies. You may:

  • Purchase under the applicable CUA from a CUA contractor; or
  • Exercise your discretion to purchase outside the CUA, and purchase in accordance with Western Australian Procurement Rules and Buy Local policy.  

Before you buy, also check that your purchase falls within your organisation's procurement policies.

In accordance with Western Australian Procurement Rules, you can buy outside of this CUA and directly source from an Australian Disability Enterprise (ADE) or Aboriginal Business.

Applicable GCOC

The General Conditions of Contract (August 2019) applies to this arrangement.

What's on offer?

Agricultural Chemicals

Agricultural Products are defined as any substance or organism that is used to:

  • Destroy, stupefy, repel, inhibit the feeding of, or prevent pests on plans;
  • Destroy a plan or modify its physiology;
  • Modify the effect of another agricultural chemical products; 
  • Attract a pest for the purpose of destroying it.

Agricultural Chemicals include herbicides, insecticides, fungicides and wetting agents.

Fertilisers

Fertilisers are defined as any product that fits one or more of the following definitions:

  • A substance containing nitrogen, phosphorus, potassium or any other element required for plant growth, or a compound of such a substance, manufactured, prepared, produced or supplied for the purpose of fertilising the soil or supplying nutriments to plants.
  • A substance used for conditioning the soil for the purpose of fertilising the soil or supplying nutriments to plants.
  • Any materials applied to promote plant growth.

The fertiliser products include bagged and bulk products, bought both in small amounts (e.g. 25kg bags) or large orders (e.g. 50 tonnes). 

Fencing Products

Products required for fencing maintenance and installation, including posts, wire and fencing accessories such as struts and strainers.

General Agricultural Merchandise

Other agricultural products, including but not limited to water equipment, specialised clothing and footwear, animal feed, general hardware, and animal healthcare products such as vaccines and drenches.

Out of scope activity

In instances where a customer requires specialist chemical or fertiliser products not available through contractors under this contract, either at all or within an appropriate timeframe, this shall be considered outside the scope of this contract.

Livestock is excluded from the scope of the contract.

Turf specialist products and related services are also excluded from the scope of the contract.

Buying rules

Buying direct

There are monetary threshold buying rules that apply to this CUA. Thresholds below are GST Inclusive.

“Pick and Buy” – Panel members may be accessed directly.

Customers should obtain prices and ensure that the relevant discount margin has been applied.

$250,000 or above per order up to $5 million

Formally request sufficient number of written quotations from relevant Panel Members.

Formally request sufficient number of written quotations from relevant Panel Members.

Customers must engage the Department of Finance for assistance.

Buyers should view the What will it cost? section to review the discounts they are entitled to under the contract. Where more than one contractor is appointed to a category or sub category, buyers can evaluate which contractor represents best value for money for their needs, then contact the contractor to make their purchase.

Other policy requirements

State agencies should be aware of the following requirements under Western Australian Procurement Rules as they apply to purchases from this CUA.  The below table is a summary of the requirements, and State agencies are encouraged to review the WA Procurement Rules.

Procurement Planning

Please note that State agencies are not required to request advice or approval from the Department of Finance, regardless of value, to purchase from an ADE or an Aboriginal Business (WA Procurement Rule C2.2).

Request Development and Contract Formation

Buyers must prepare an evaluation report.

Contract Management

Buyers must prepare a contract management plan. Contract management or project management plans must be developed for all Procurements with a Total Estimated Value of $5 million and above (WA Procurement Rule E1(1)), unless exempted under WA Procurement Rule E1(2).

Exemption from using this CUA

This CUA is non-mandatory statewide. Therefore, State agencies do not require an exemption to purchase outside of the CUA.

Sustainability

As part of the tender process, contractors on this arrangement have provided details of, and have been evaluated on, their sustainability initiatives, systems, or accreditations that have been implemented to achieve improved environmental and/or sustainability outcomes within the organisation’s operations and/or contract delivery.

The cost will vary depending on the Products purchased.  Contractors have committed to providing discounts of their Recommended Retail Price.

Payment by Purchasing Card

The government Purchasing Card offers a quick and convenient method of payment allowing many goods and services to be efficiently purchased. 

Always remember to inform the contractor that you will be paying by government Purchasing Card, at the time of ordering the product or service, and ensure they clearly understand that they must send the tax invoice directly to you, the cardholder. 

Making the most of this contract

  • As prices are discounts on RRP or cost-plus pricing, consider contacting several contractors to compare prices.
  • Quote the contract number (CUAAGR2019) when ordering. 
  • Ask contractors to advise their current Recommended Retail Price (RRP) or cost price when you order so you can ensure you are receiving your full discount.

How do I buy?

Prices for this Common Use Arrangement (CUA) are based on discounts of RRP.

Purchases should be made in accordance with the Buying Rules. 

While buyers can pick and buy the specified products (up to the value of $250,000) from the contractors without calling quotes or tenders, you may wish to compare prices for the product you require from two or more suppliers by contacting them directly.

Where more than one contractor is appointed to a category or subcategory, buyers can evaluate which contractor represents best value for money for their needs, then contact the contractor to make their purchase.

What to do with the Quote Form

Buyers are required to seek quotes according to the Buying Rules (above $250,000).

The best way of using the Quote Form is to list the product specification that you need, and then send it to the relevant contractors.

Agencies must manage the quotation process in accordance with the terms and conditions detailed in the agency’s partial Exemption, including documenting the agency’s value for money decision.

Buyers should be aware that for purchases above $5 million and above, they must engage the Department of Finance

After I buy

Active contract management pays off

  • Check your invoices to ensure the correct price has been charged.
  • Test the market on a regular basis to see what the other contractors on the CUA are offering
  • Check invoices for accuracy before authorising payment.
  • Document any issues as they arise even if they are resolved. This will assist in ongoing contractor performance management.
  • If you are unable to resolve issues, please contact the contract manager.
