On 4 September 2025, the ERA published a notice advising that it had found that Alinta Sales Pty Ltd (Alinta) breached the WEM Rules between October 2023 and June 2024.
On the same date, lawyers representing the ERA applied to the Board, to determine whether orders should be made against Alinta and a penalty imposed upon it.
On 22 December 2025, the Attorney General appointed Scott Ellis as the Presiding Member of the Electricity Review Board to hear the application.
On 15 January 2026, Mr Ellis appointed Mr Mark Johnston and Mr Simon Orme as the members from the Panel of Experts to the Board.
