Ensuring that WorkSafe WA is updated when information relating to your plant changes is important to maintaining the safety of workplaces in Western Australia. Similar to updating the Department of Transport when key information or the ownership of your car changes, the change to information process allows for updates to be made when an item of plant changes hands or when the registration holders information changes.
When to do a change to information
A change to information is required within 14 days after a registration holder becomes aware of change in registration information. A change to information is not the same as an alteration of a design; however, a change to information will be required within 14 days of the registration of a design alteration, where the design alteration is related to your item of plant. Changes to information do not include minor corrections to registration documents where an error or incorrect information exists on the registration certificate.
Transfer or sale of the item of plant
Similar to selling or purchasing a car, transferring or selling an item of plant or changing the person with management or control of an item of plant will require the registration holder to lodge a Form 202 - changes to plant information. A person with management or control is typically the owner, contracted service provider or other person who regularly use, manage and has control over the use of the item in question. It is the responsibility of the current registration holder to notify WorkSafe WA within 14 days of a sale, transfer or change of the person with management or control of the plant.
When buying plant, it is important to understand that the registration holder is responsible for updating the plant registration information. If the registration holder is uncontactable or if the plant is purchased through a third party that is not the registration holder, you may not be able to have the plant registration transferred or changed into your name.
If you have purchased plant that cannot be transferred for the above reasons the following exemptions may apply to you:
Change to registration information or plant information
In addition to selling, transferring or changing the person with management or control of an item of plant, a Form 202 - Change to information will be required within 14 days of any of the following occurring:
- The registration holder no longer having management or control of an item of plant. This includes sale, transfer or disposal/ withdrawal of an item of plant;
- Relocation of fixed plant; or
- Alteration to plant that requires new control measures.
The change to information may only be done by the registration holder.
