The Minister for Commerce, the Hon. Dr Tony Buti MLA, has approved the release of a draft version of the Building and Construction Industry (Security of Payment) Amendment Bill 2025 (the Bill), as well as the supporting draft regulations, for public consideration and feedback.

The Bill will strengthen security of payment for subcontractors working on State Government construction projects and streamline payment protections. It will replace the current project bank account system with a more robust and streamlined construction trust scheme.

The Bill will also make minor amendments to existing security of payment laws by providing greater clarity and transparency regarding the adjudication process and powers of the building industry regulators.

The Bill continues to raise the benchmark across Australia for ensuring subcontractors and suppliers receive timely payments for their work.

The draft Bill and regulations are open for consultation for six weeks. A brief explanatory statement and supporting information has been provided below.

Comments received will be considered before the Bill is introduced into the Western Australian Parliament later this year.
