WA’s home building contract legislation is undergoing a major review examining the Home Building Contracts Act 1991 (except Part 3A); and the dispute resolution/complaint process in Parts 2 and 3 of the Building Services (Complaint Resolution and Administration) Act 2011, led by Parliamentary Secretary, Hon Dan Caddy MLC.
This review will ensure WA’s home building contract laws framework remains modern, accessible, and fit for purpose, providing appropriate safeguards for homeowners, while supporting a stable and resilient building industry. Recent challenges experienced by consumers and builders highlight the need for clearer regulation and stronger, earlier intervention powers.
The WA Government has already announced enhanced authority for the Building Services Board and the Building Commissioner to better manage at-risk contractors and protect consumers, with a Bill introduced to Parliament in May 2026.
An earlier phase of the review process included consultation with consumers (homeowners) and building industry participants to have their say on potential improvements and share their views and experiences through online surveys. The findings of the surveys and written submissions were compiled and analysed to inform the preparation of a discussion paper with a set of proposed reforms.
Consumers and industry are now invited to have their say on proposed reforms and improvements, and provide broader feedback, to the laws governing home building contracts with the release of the discussion paper and associated survey.
The public and industry have until 5:00pm on 24 June 2026 to provide feedback.
View the discussion paper and have your say via the online survey.
