We make decisions when there is disagreement about clean up and remediation responsibilities and classifications of contaminated sites.

What we do

We are an independent statutory administrative tribunal established under Section 33 of the Contaminated Sites Act 2003 and appointed by the Minister for Environment.

We determine:

  • appeals against site classifications and investigation or clean up notices given by the Chief Executive Officer of the Department of Water and Environmental Regulation
  • responsibility for remediation of contaminated sites
  • responsibility for remediation to facilitate recovery of State costs incurred at orphan sites
  • whether to cancel, amend or transfer exemption certificates.
