These are the approved forms under the Petroleum, Geothermal Energy and Greenhouse Gas Storage Act 1967 (PGEGGSA), Petroleum and Greenhouse Gas Storage (Submerged Lands) Act 1982 (PGGS(SL)A) and the Petroleum and Greenhouse Gas Pipelines Act 1969 (PGGPA) (together, the Acts).
Request for search of a title
Under the Acts, the Minister may upon payment of the prescribed fee, supply certified copies of or extracts from the register or from any instrument lodged under the Acts. The current prescribed fee can be found in the Schedule of Fees.
A request for the search of a title must be made using the approved form (found below) and submitted to the department.
It is recommended to contact the department via email to petroleum.titles@dmpe.wa.gov.au prior to submitting your application, as the information sought may be obtainable via the Petroleum and Geothermal Register without charge.
Application for the nomination of a registered holder for the service of documents
Under the Acts, where there are two (2) or more registered holders (titleholders) of a title, those registered holders must nominate one of the registered holders as being the holder on whom documents relating to the title can be served. Each of the registered holders must complete and execute the application form. It cannot be completed by one of the registered holders for and on behalf of all registered holders.
An application to nominate a registered holder for the service of documents must be made using the approved form (found below) and submitted in PGR. There is no fee to apply.
Devolution of title
An application for a devolution of a title must be made using the approved form (found below) and submitted in PGR together with the following information:
- the original instrument evidencing the devolution (document showing sufficient evidence that the holder’s rights have devolved by operation of law), executed by all parties to the devolution, together with one executed or certified copy, and two copies of the application form;
- a brief description of the devolution;
- participating interests held by the Devolutor(s) and subsequent participating interests of the Devolutee;
- incoming corporation(s) and its relationship to any major corporation or group, substantial shareholding, directors, principal business activity and place of incorporation/business (where a current annual report reveals all the above information, such is acceptable);
- incoming corporation's financial status and its ability to fund its share of the venture;
- technical expertise of, and available to, the incoming corporation and particulars of other current and previous involvements in petroleum exploration and development;
- where Devolution is submitted under the Petroleum and Greenhouse Gas Pipelines Act 1969, provide a completed Registration form from Landgate for the registration of new titleholders against the easements under the Transfer of Land Act 1893 as amended; and
- any time constraints written into the instrument should be highlighted.
