The new State Planning Policy 3.7 Bushfire has been published on 24 September 2024 and will be operational from 18 November 2024, along with the Planning for Bushfire Guidelines.
The ‘deferred implementation’ of the new policy is to allow industry and decision makers a period to prepare for the implementation of new policy measures.
When SPP 3.7 and the Guidelines come into operation on 18 November 2024, there may be planning applications that have or are still being prepared under the 2015 version of SPP 3.7 and version 1.4 of the Guidelines.
Decision-makers can consider currently lodged applications under the previous (2015) policy framework, in acknowledgement that some proponents will have expended significant time and funds in preparing their application. Applications lodged after 24 September 2024 and determined on or after 18 November 2024 are to be assessed under the 2024 policy framework.
Proponents are being encouraged to contact the relevant decision maker to establish which version of the SPP and Guidelines to use for the proposal. This should be discussed as early as possible with the decision-maker.
