The approved provider, Young (2013) Pty Ltd as Trustee of the Young Family Trust, which operates the approved service Little Rascals Outside School Hours Care, was ordered to pay $17,000.00 by the State Administrative Tribunal for contravening section 165(1) of the Education and Care Services National Law (Western Australia) for the offence of inadequate supervision of a child, as well as for contravening regulation 102E(2) of the Education and Care Services National Regulations (WA) 2012 for failing to ensure compliance with mandatory requirements regarding children embarking a means of transport at the education and care service premises.
A Department of Communities investigation found that on 3 June 2025 a ten-year-old child was left at the service unsupervised for approximately thirty minutes.
The educators at the service failed to ensure all children were accounted for when the children were embarking vehicles to depart for school.
The ten-year-old was found left behind at the service by educators when they returned from school drop off.
While the service was within the required educator to child ratio, the investigation found inadequate supervision practices contributed to the incident.
The approved provider Young (2013) Pty Ltd as Trustee of the Young Family Trust has been ordered to pay $2,000.00 towards the Department of Communities’ legal costs.
