Application No 1 of 2010 and No 2 of 2010

On 19 August 2010, an application for review of the Economic Regulation Authority’s final decision on the revised access arrangement for the Goldfields Gas Pipeline was lodged by BHP Billiton Nickel West Pty Ltd (Application 1/2010). An application was also lodged by Southern Cross Pipelines Australia Pty Limited, Southern Cross Pipelines (NPL) Australia Pty Ltd, Alinta DEWAP Pty Ltd and Goldfields Gas Transmission Pty Ltd (Application 2/2010). Both applications were lodged pursuant to section 39(1) of the Gas Pipelines Access (Western Australia) Act 1998 (which provision continues to apply by reason of section 28(4) of Schedule 3 of the National Gas Access (WA) Act 2009).

On 19 October 2010, the Attorney General appointed Mr Scott Ellis as the Presiding Member of the Western Australian Electricity Review Board to hear the application for review in relation to Application 1/2010 and Application 2/2010. On 2 November 2010, Mr Ellis appointed Mr Ted Woodley and Mr Brendan Gaynor as Expert Members of the Electricity Review Board. On 16 December 2010, Mr Brendan Gaynor withdrew as an Expert Member of the Electricity Review Board on the basis of a possible perception of a conflict arising out of previous interests. On 23 December 2010, Mr Ellis appointed Mr Graham Mathieson as Expert Member.
