Recommendation for an entry in the State Register of Heritage Places

P9957 Hale School Memorial Hall

Hale School Memorial Hall at 20 Unwin Avenue, Wembley Downs and comprising Portion of Lot 123 on D20292 Vol. 1279 Fol. 452.

Pursuant to section 40 of the Heritage Act 2018, the Heritage Council has made the following recommendation to the Minster for Heritage on 22 March 2024:

  1. the place listed above is of cultural heritage significance pursuant to s.38(1) of the Heritage Act 2018;
  2. the place makes an important contribution to understanding the heritage of Western Australia as detailed in the proposed statement of significance in the draft register entry; and,
  3. the place should be entered in the State Register of Heritage Places.

Recent entry in State Register of Heritage Places

P27015 Customs House and Sub-Collector’s Residence, Broome

Customs House and Sub-Collector’s Residence, Broome at 67-69 Robinson Street, Broome and comprising Lot 4 on Diagram 69750 being the land contained in Certificate of Title Volume 1727 Folio 480 and Lot 3 on Diagram 69750 being the land contained in Certificate of Title Volume 1727 Folio 479.

The Minister, having regard to the recommendation and advice of the Heritage Council given under section 40 of the Act in relation to the place, is satisfied that:

  1. the place has cultural heritage significance; and
  2. the place makes an important contribution to understanding the heritage of Western Australia as detailed in the proposed statement of significance in the draft register entry.

On 19 March 2024, the Minister directed the Heritage Council to enter the place in the State Register of Heritage Places pursuant to s.42 of the Heritage Act 2018.

P1302 Endowment Block, Kalgoorlie

Endowment Block, Kalgoorlie 250-316 Hannan Street, Kalgoorlie and comprising Lots 151-160 on Deposited Plan 222587 being the whole of the land contained in Certificates of Title Volume 1704 Folios 880-889 and a portion of road reserve – Hannan Street.

The Minister, having regard to the recommendation and advice of the Heritage Council given under section 40 of the Act in relation to the place, is satisfied that:

  1. the place has cultural heritage significance; and
  2. the place makes an important contribution to understanding the heritage of Western Australia as detailed in the proposed statement of significance in the draft register entry.

On 29 December 2023, the Minister directed the Heritage Council to enter the place in the State Register of Heritage Places pursuant to s.42 of the Heritage Act 2018.

Tudor Style Shops, Renkema Building located at 134 Stirling Highway Nedlands and being Lot 5 on P3008 Certificate of Title SP48889; Lot 1 on SP48889 C/T Vol. 2665 Fol. 306; Lot 2 on SP48889 C/T Vol. 2665 Fol. 307; Lot 3 on SP48889 C/T Vol. 2665 Fol. 308.

The Minister, having regard to the recommendation and advice of the Heritage Council given under section 40 of the Act in relation to the place, is satisfied that:

1. the place has cultural heritage significance; and
2. the place makes an important contribution to understanding the heritage of Western Australia as detailed in the proposed statement of significance in the draft register entry.

On 20 December 2022, the Minister directed the Heritage Council to enter the place in the State Register of Heritage Places pursuant to s.42 of the Heritage Act 2018.

Pursuant to section 44 of the Heritage Act 2018, the amendment to the land description of the above place to be Portion of Lot 30 on Deposited Plan 41565, being the part of the land contained in Certificate of Title Volume 2567 Folio 483 together as shown on Heritage Council Map P429-4, was approved by the Minister for Heritage on 7 January 2022, subject to the following condition:

(a) approval of the subdivision and subsequent lodgement of the documents at Landgate.

P802 Aldgate House & Stables, East Fremantle

Aldgate House & Stables, East Fremantle, located at 7 Aldgate Place and 55b Staton Road, East Fremantle, and comprising Lot 16 on Diagram 89642, being the whole of the land contained in Certificate of Title Volume 2064 Folio 994 and Lot 11 on Diagram 87643, being the whole of the land contained in Certificate of Title Volume 2020 Folio 589.

(a) to recommend that the Minister amend the land description to be increased to comprise Reserve 7123 being Lot 557 on Deposited Plan 73153 containing the whole of the land contained in Crown Land Record Volume 3163 Folio 54 and shown on Heritage Council Curtilage Map P1973-0.

P2390 South Perth Police Station

South Perth Police Station, 1 Mends St, South Perth comprising Portion of Lot 688 on Deposited Plan 403809 being part of the land contained in Certificate of Title Volume 2963 Folio 868 as to the portion labelled ‘M’ on said Plan.

Pursuant to section 44 of the Heritage Act 2018, the amendment to reduce the land description for the abovementioned place to be portion of Lot 688 on Deposited Plan 403809 being part of the land contained in Certificate of Title Volume 2963 Folio 868 and Lot 311 and portion of Common Property on draft Strata Plan 70243 together as shown on HC Map P2390-1 was approved by the Minister for Heritage on 1 September 2020, subject to the following conditions:

(a) the approval of the Strata Plan subdivision and subsequent concurrent lodgement of the notification of the amended entry under s. 163(3), Strata Plan, and Deposited Plan at Landgate; and,

(b) the owner paying all costs associated with amending the land description, including drafting or re-drafting of plans and any processes relating to lodgement of documents at Landgate.

P46 Hawthorndene

Pursuant to section 44 of the Heritage Act 2018, the amendment to reduce the land description for the abovementioned place to be portion of Lots 24, 25 and 26 on Plan 190 being part of the land comprised in Certificates of Title Volume 1348 Folios 508, 509, and 510 respectively together as defined in HC Curtilage Map P46-1 was approved by the Minister for Heritage on 4 November 2020, subject to the following condition:

  1.  that the amended land description of Oliver Hill Battery, Wadjemup/Rottnest Island should be as shown on Heritage Council Curtilage Map P526-1; 
  2. to update the name of the place to World War II Buildings, Oliver Hill Battery and Signal Ridge, Wadjemup/ Rottnest Island; and 
  3. to request the Department consult each owner of the place, in relation to the proposed amendment.

The Heritage Council invites submissions on the proposal pursuant to the Act and (where relevant) section 24MD of the NTA, which should be forwarded to the Department of Planning, Lands and Heritage no later than Tuesday 31 December 2019. P17868 Peel Town Archaeological Sites, Henderson (near Mount Brown, Beeliar Regional Park) – Notice of Revocation of Protection Order

On 8 December 2022 P17868 Peel Town Archaeological Sites was entered in the State Register of Heritage Places. 

Given the place is now afforded protection under the Heritage Act 2018, the Minister revoked the Continuing Protection Order, which has been in place to protect the site, via publication in the Government Gazette on 18 April 2023. 

P18005 Cullity Timbers (fmr), Leederville – Does Not Meet the Conditions

On 25 August 2023 the Heritage Council resolved that, based on the information presented the place is unlikely to have the cultural heritage significance required for meeting the condition for entry in the State Register under section 38 of Heritage Act 2018. The place has therefore been removed from the Heritage Council’s Assessment Program.

P18182 Lake Monger Velodrome (fmr) – Notice to Remove Place from Heritage Council’s Assessment Program

On 24 March 2023 the Heritage Council resolved that, based on the information presented, the place is unlikely to have the cultural heritage significance required for meeting the condition for entry in the State Register under section 38 of the Heritage Act 2018 and therefore does not warrant full assessment. The place has therefore been removed from the Heritage Council’s Assessment Program.

P4226 Gwalla Precinct, Northampton - Notice to Remove Place from Heritage Council’s Assessment Program

On 29 July 2022 the Heritage Council resolved that, based on the information presented, the place is unlikely to have the cultural heritage significance required for meeting the condition for entry in the State Register under section 38 of the Heritage Act 2018 and therefore does not warrant full assessment. The place has therefore been removed from the Heritage Council’s Assessment Program.

Notice to Include Places in Heritage Council’s Assessment Program

On 27 May 2022 the Heritage Council resolved that the following places should be considered as part of an expansion to the registered curtilage for P11381 Pemberton Timber Mill Workers’ Cottages Precinct:

  • P27051 Pemberton School (fmr) and Surrounds [incl. 1521 School (fmr)]
  • P25014 Pemberton Mill & Chimney Complex
  • Portion of P4637 Pemberton-Northcliffe Railway & Railway Station (RHP)
  • P25056 Pemberton Sports Club
  • P18918 Pemberton Mill House Café
  • P11378 Warren Lodge
  • P1523 Mill Workers’ Hall (RHP)
  • P11379 Pemberton Bakery & Deli
  • P18894 Medical Centre

To that end, they have been included in the Heritage Council’s Assessment Program. Information about the above places can be viewed on inHerit.

P5358 Route of the Ballarat Railway Line – Notice to Include Place in Heritage Council’s Assessment Program

On 13 August 2021 the Heritage Council resolved that the above place warrants full assessment for consideration for entry in the State Register of Heritage Places. The place has therefore been included in the Heritage Council’s Assessment Program. Information about the place can be viewed on inHerit.

Places removed from the Register

Entries in the new State Register of Heritage Places were not made for the following eight interim registered places in accordance with s.178(4) of the Heritage Act 2018 (Act) before the 2nd anniversary of commencement day of the Act. The places are therefore no longer taken to be registered places and have been removed from the Register:

On 22 January 2021 the Heritage Council resolved that, based on the information presented the place, in its entirety, is unlikely to have the cultural heritage significance required for meeting the condition for entry in the State Register under section 38 of Heritage Act 2018 and therefore does not warrant full assessment. The place has therefore been removed from the Heritage Council’s Assessment Program.

Heritage Act 2018

Heritage Act 2018 and Regulations

1 July 2019, the Heritage of Western Australia Act 1990 was replaced by the Heritage Act 2018.

Key changes in the new Heritage Act 2018 include a streamlined process for entering a place in the State Register; more certainty for owners wishing to develop their heritage places; better protections for important heritage places; and increased transparency by publishing the Heritage Council's advice to the Minister for Heritage on the inclusion of a place in the State Register.

The Act refers to ‘regulations’ or ‘prescribed matters’ in several areas, with these defined under accompanying Regulations, that are issued by the Governor to ensure that the Act can function properly. The Heritage Regulations 2019 were adopted for the commencement of the Heritage Act 2018 and were considered the minimum regulations necessary for the Act to operate effectively.
