Under the Planning and Development Act 2005 (the Act) if the Minister for Planning considers an application to the State Administrative Tribunal (SAT) raises issues of such State or regional importance that it would be appropriate for the application to be determined, the Minister may call in the application for determination.
The Acting Minister for Planning on 21 April 2022 called in the application for review from SAT for determination by the Minister for Planning in accordance with section 246(2)(a) of the Act. A process was put in place to receive and exchange submissions from the applicant and the Shire of Harvey.
On 5 September 2025 the EPA published its Notice to amend the Kemerton Strategic Area Industrial Strategic Proposal, Assessment No 2317 by excluding privately owned land including Lot 7 from the EPA’s assessment.
