SES contracts

Chief executive officers and employing authorities prepare and execute SES contracts up to a maximum of 5 years using the SES contract template or SES (Special Division) contract template as applicable.

As required under Commissioner’s Instruction 32: Financial and Classification Management of Senior Executive Service and Other Management Executives, agencies must seek approval from the Commissioner for any variations to the SES contract template. This ensures variations do not change the intent of a specific clause or the SES contract generally which may have unintended legal or other consequences.

Commissioner’s Instruction 32 also requires SES contracts to be sent to the Commission within 10 days of being signed by both parties.

A copy of attraction and retention incentives approved by the Commissioner are also to be sent to the Commission within 10 days of being signed by both parties.

Other management executive contracts

Officers are appointed to these positions through contracts of employment (not SES contracts).

Key contract details for SES contracts and other management executive contracts, including any attraction and retention incentives approved by Government Sector Labour Relations, are to be sent to the Commission within 10 days of being signed by both parties.

Contracts for specialist positions

Commissioner’s Instruction 33: Determining Remuneration of Specialist Positions allows agencies to remunerate people in highly specialised positions where it is determined that market forces, the uniqueness, expertise or experience required are beyond the scope of a classification system, award, order or industrial agreement.

Chief executive officers must seek approval from the Commissioner before entering into a contract with a person under this instruction. A contract of employment entered into under this Instruction must be for a fixed term and the CEO must use the contract prepared by the Commission.

A copy of the signed contract is to be sent to the Commission within 10 days of being signed by both parties.
