Details on applying for a new real estate and business agent licence - Partnership or Body Corporate.

A partnership or body corporate/company that intends to operate as a real estate or business agent in Western Australia must hold a real estate and business agent licence, and a current triennial certificate, as required under the Real Estate and Business Agents Act 1978

Licensed persons and control of the business

The licence must meet the following licensing thresholds:

  • The person in bona fide control of the business operated under the licence must be licensed. If none of the licensed partners or directors is undertaking this role, the partnership or directors must nominate a licensed person to act in bona fide control.
    • Three or fewer partners or directors: at least one must be licensed
    • More than three partners or directors: at least two must be licensed

An unlicensed partner or director who resides in Western Australia must hold a sales representative registration to perform sales representative functions.

  • Two business references for each partner/director completed using the pro forma;
  • A police check for each partner/director (dated within the past 3 months, showing the same name as your identification);
  • Visa/Mastercard for fee payment.
