It applies to prosecutions for offences under the legislation administered by the department and as the circumstances allow, to appeals arising out of proceedings in respect of any such prosecutions.
The guideline is intended to guide and assist department officers in the performance of their functions and is not a substitute for the professional judgment of those officers.
