The Prosecutions Guideline outlines the principles and approach the Department of Water and Environmental Regulation (the Department) applies when considering and conducting prosecutions for offences under the legislation it administers.
The guideline was updated in 2026 to align with the Department’s current compliance and enforcement approach and provide clearer guidance on prosecution decision-making.
The guideline supports consistent, fair and transparent decision-making in relation to prosecution actions. It also provides guidance on managing prosecution processes, including appeals arising from those proceedings, where relevant.
The guideline is intended to assist departmental officers in the performance of their functions. It does not replace the need for professional judgement in individual cases.
