Kwinana used tyre storage facility staff fined for licence breaches

A former company director and operations manager at a used tyre storage facility in Kwinana were convicted in Rockingham Magistrates Court recently for breaching its operating licence, despite the company being liquidated in December 2018.

On 27 February 2020, Antonio Giacci and Sabatino Giacci were each fined $15,000 and ordered to pay $493.90 in costs for failure to adhere to aspects of its licence related to fire safety measures.

Giacci R Pty Ltd was issued a licence under Part V, Division 3 of the Environmental Protection Act 1986 in June 2017 to operate the used tyre storage facility.

Department of Water and Environmental Regulation (DWER) inspections between August 2017 and May 2018 identified numerous non-compliances with the licence.

DWER Executive Director Compliance and Enforcement Stuart Cowie said the conviction sent a strong message that businesses will be held responsible for continued non-compliance with environmental licence conditions.

“In this instance, even though the company had gone into liquidation, the company director and operations manager were still held accountable for the breaches identified,” he said.

“I hope this sends a clear message to businesses and the community that noncompliance in relation to environmental licences will not be tolerated.”
