The Equal Opportunity Bill 2026 - An opportunity for thoughtful and respectful discussion

The Commission acknowledges the introduction of the Equal Opportunity Bill 2026 (the Bill) and recognises the important role the Bill plays in ensuring Western Australia has modern, fair and effective anti-discrimination laws.

This post is not intended to comment on the detail of the Bill's provisions. If you are interested in learning more about the Bill and its intended objectives, you can read Dr Tony Buti's second reading speech HERE.

While not commenting on the detail of the Bill, the Commission notes that its overarching purpose is to promote fairness and protect people from unlawful discrimination. In doing so, it reflects the importance of safeguarding the dignity, worth and equal standing of every person within our society.

Fairness and respect do not occur automatically. They require thought, consideration and effort from each of us. Likewise, the protection of human dignity and worth cannot be taken for granted. It requires an ongoing commitment to ensuring these principles are reflected in meaningful and practical ways.

With this in mind, the Commission highlights the importance of fostering a social environment that supports respectful, informed and positively motivated discussion about the Bill, including debate on its specific provisions.

The Bill is intended to serve the community by helping to shape a society founded on respect for all people. An important part of this is ensuring consideration is given to those who may be most vulnerable to discrimination and exclusion. This requires space for a diversity of voices, experiences, perspectives and needs, while approaching discussion with respect, thoughtfulness and a willingness to engage with differing views. In doing so, we create the best opportunity to achieve outcomes that serve the broader community while recognising the inherent value and dignity of every individual, balancing the needs of the whole with respect and grace for each person.
