The Aboriginal Cultural Heritage Act 2021 (the Act) will be proclaimed on 1 July 2023 and will be the State’s legislative instrument for the protection of Aboriginal cultural heritage, replacing the Aboriginal Heritage Act 1972.
The Act provides a modern framework for the recognition, protection, conservation, and preservation of Aboriginal cultural heritage while recognising the fundamental importance of Aboriginal cultural heritage to Aboriginal people.
Key guidelines to support the Act have been released following an extensive co-design process.
Throughout 2022 a three-phase co-design process was undertaken by the Department of Planning, Lands and Heritage (DPLH) to develop a set of guidelines to support the Act. Throughout this co-design process DPLH conducted comprehensive consultation with stakeholders across Western Australia on the guidance materials to support the legislation.

DPLH is now facilitating education workshops throughout the State to support the implementation of the new legislation. The workshop will provide an overview of the Act, along with guidelines and regulations, the commencement process and will provide an opportunity for attendees to ask questions.
All workshops will run from 10:00am to 1:30pm. Lunch will be provided at the end of each session.
