The Bill establishes a modern approach to protecting Aboriginal cultural heritage and resets the relationship between land users and Traditional Owners.
Provisions under the Bill will improve the approvals process, provide rights of review to all parties, strengthen compliance and enforcement and improve record-keeping of cultural heritage and transparency in decision-making.
The State Government sought feedback on the Bill to ensure Western Australia has a serious law that protects and respects Aboriginal culture and balances outcomes for all stakeholders. Submissions closed 9 October 2020.
Further consultation with Traditional Owners, Aboriginal organisations and people and other stakeholders continued to be undertaken in 2021 resulting in refinements to the draft Bill.
