Exemptions and regulations under part V of the Environmental Protection Act 1986
Last updated: 29 March 2023

If you intend to clear native vegetation, you will need to apply for a permit from either the Department of Water and Environmental Regulation or the Department of Mines, Industry Regulation and Safety, or otherwise an exemption must apply. It is an offence to clear native vegetation without the authority of a permit or an exemption.

This guide explains what the exemptions are, the circumstances in which they apply and what is defined as intentionally planted vegetation.
