Instrument of delegation (appointment of acting chief executive officers)

Pursuant to section 23 of the Public Sector Management Act 1994 I, Sharyn O’Neill, Public Sector Commissioner, hereby delegate to each person holding the position of Chief Executive Officer, as defined under the Act, and each employee directed by me to act in the office of the Chief Executive Officer, the power conferred on me by section 51 of the Act to the extent as follows: namely, in any case in which the Chief Executive Officer or the Acting Chief Executive Officer is absent from duty or for any reason unable to perform his or her functions, the power to direct an employee in the Public Sector to act for a period not exceeding three months in that office of Chief Executive Officer during the absence or period of inability.

This delegation is subject to the provisions of section 51 of the Act and the delegate, before exercising the delegated power, obtaining the approval of the responsible authority of the agency concerned and, if that responsible authority is not the Minister responsible for that agency, the approval of the Minister, and if the employee is not employed by the Chief executive officer, the approval of the employee’s employing authority.
