As a manager or a human resources officer in the public sector, you have the challenging task of managing inappropriate or problematic behavior in the workplace.

The information below outlines key aspects of the Public Sector Management Act 1994 (PSM Act) to help you consider disciplinary processes as needed, and supporting resources for you and for staff in your agency.

The right course of action

Managing workplace behaviour - A guide for agencies helps you decide which process to use when managing a behavioural issue. It sets out the legislative foundation, characteristics and aims of the key human resources processes used to manage grievances, substandard performance and breaches of discipline.

The Commission’s Integrity Advisory Service can provide you with information about disciplinary processes, and the Workforce Practice team can answer queries about grievances and substandard performances.

Disciplinary processes

Inappropriate behaviour in the workplace can have negative impacts on agency staff and business, as well as jeopardize public confidence and trust. Part 2 of the PSM Act describes the core values and behaviours expected of all public sector employees, while the disciplinary process is set out in Part 5.

Commissioner’s Instruction No.3: Discipline – general and Commissioner’s Instruction No.4: Discipline – former employees outline the minimum procedural requirements to follow when dealing with disciplinary matters under part 5 of the PSM Act.

The following resources will help you understand disciplinary processes and investigations.

Preventing bullying

Bullying is not acceptable behaviour and should not be tolerated in the workplace. It is a breach of the WA public sector Code of Ethics and of occupational safety and health legislation.

It is every public sector employee’s responsibility to foster and contribute to a high integrity workplace culture, where everyone is treated with courtesy, consideration and respect.
