Employees in the state industrial relations system who are not covered by a WA award or industrial agreement are called award free employees. Award free employees must be paid at least the State Minimum Wage rate of pay in the table below.
There are different minimum rates of pay for award free apprentices and trainees. These are listed in the Award free minimum pay rates and entitlements summary.
The yearly State Wage Case sets the minimum pay and award wages. Pay increases usually apply from the beginning of the first pay period that starts on or after 1 July each year.

Award free employees must be paid at least the minimum hourly rate (listed in the tables above) for every hour that they work.
For full time employees, the minimum weekly rate applies for the first 38 hours each week, and each extra hour of work must be paid at the minimum hourly rate. A part time employee must be paid the minimum hourly rate of pay for each hour of work.
For casual employees, each hour of work must be paid at the minimum casual hourly rate of pay, which includes a casual loading.
There is no minimum entitlement for an award free employee to receive a higher pay rate when working overtime (more than 38 hours a week) or when working on weekends or public holidays. There are requirements about reasonable hours of work.

Show moreEmployees paid by commission or piece rates (whether wholly or in part) in the state industrial relations system are entitled to minimum conditions under the Minimum Conditions of Employment Act including the minimum rates of pay.
Employees paid by commission or piece rates may be covered by a WA award. If an employee is covered by a WA award, the entitlements outlined in the WA award must be provided to the employee, and it is unlawful to provide pay rates or leave conditions below the WA award provisions.
Prior to 20 June 2022, employees in the state industrial relations system who were paid wholly by commission or percentage reward, or wholly by piece rates were excluded from the definition of ‘employee’ in the Minimum Conditions of Employment Act.
This exclusion meant that these employees who were not covered by a WA award were not entitled to the state minimum wage and other minimum conditions of employment provided in the Minimum Conditions of Employment Act.
