The Freedom of Information Act 1992 (FOI Act) recognises two kinds of requests for access to information, personal information and non-personal information. Personal information is information about the FOI applicant. This includes, but is not limited to, information from which the identity of the applicant is apparent or can reasonably be ascertained (i.e. names or contact details).
Non-personal information is information concerning people other than the FOI applicant. This also includes, but is not limited to, information, opinions, names or contact details
The FOI Act allows a person to have access to personal information about themselves, subject to some limitations. In relation to non-personal information, Schedule 1, Clause 14 of the FOI Act and section 167 of the Equal Opportunity Act 1984 (the Act) exempt the Equal Opportunity Commission from disclosing to third parties any information relating to the affairs of a person obtained by the Commission for the purposes of the Act. However, if you were a party to a complaint lodged with this Commission, you may request copies of relevant documentation from your file. To do this, the Commission will need to confirm your identity.
