This includes sexual harassment between workers, and from other people at the workplace, like customers and clients.

What is a PCBU?

A person conducting a business or undertaking (PCBU) has a primary duty of care to ensure, so far as is reasonably practicable, the health and safety of workers.

The Department of Mines, Industry Regulation and Safety has released an interpretive guideline to assist Western Australian organisations understand if they are a PCBU.

The regulator – WorkSafe WA

WorkSafe, part of the Department of Mines, Industry Regulation and Safety (DMIRS), is the Work Health and Safety (WHS) department that will assist the regulator in the administration of the Work Health and Safety Act 2020 (WHS Act). This includes the provision of inspectors and other staff to secure compliance with the legislation. The Work Health and Safety Commission has developed codes of practice which provides details information on how you can achieve the standards required under work health and safety (WHS) law.

To align with the legislative change DMIRS has consolidated all its workplace health and safety inspectorates from the existing WorkSafe, Mines Safety, Petroleum Safety, and the teams that support them, under one shared identity, WorkSafe Western Australia.

A unified identity will simplify communication about the relationship between the WorkSafe Commissioner, as the ‘regulator’ under the WHS Act, and DMIRS as the ‘WHS department’.

The new WorkSafe WA identity will assist to reinforce the message that there will be one WHS Act for almost all WA workplaces.

Safe Work Australia

Safe Work Australia is an Australian government statutory agency. It develops national policy to improve work health and safety and workers’ compensation arrangements across Australia.

What is a code of practice?

A code of practice provides detailed information on how an employer can achieve the standards required under work health and safety (WHS) law.

Codes of practice do not replace the law but can help organisations to understand what it needs to do to comply with specific regulations and provide a healthy and safe workplace.

The Work Health and Safety Commission has developed codes of practice which focus on different areas where psychosocial as well physical harms may be experienced in a workplace.
