The AES framework is governed by:
- The Electricity Industry Act 2004 including legislative amendments to give effect to the AES framework, in the form of the Electricity Industry Amendment (Alternative Electricity Services) Bill 2023, passed through the WA Parliament on 16 April 2024.
- Part 3A of the Electricity Industry Act 2004 contains the AES legislative provisions.
- Various regulations
- General regulations under the AES framework will outline consultation requirements and how confidential information will be handled by the regulator (the Economic Regulation Authority)
- Regulations will also prescribe services to be covered by the AES framework. Providers of those services will need to register with the Economic Regulation Authority and comply with obligations contained in the AES Code.
- the AES Code of Practice
- The AES Code will set out the customer protection obligations for providers of prescribed services.
The first two services to be regulated under the framework are:
- Embedded networks
- On-site Power Supply Arrangements.
Consultation on draft Regulations to prescribe those services is currently open for consultation with further consultation on the AES Code of Practice and Registration Fees to occur in the first half of 2026.
