Statutory fees

Jurors are entitled to be paid fees according to the Juries Regulations.

An attendance fee is paid for the days of jury service attendance when a juror would not normally receive an income on those days. The attendance fee is paid when the personal bank and employment details have been recorded.

If a person loses an income as a result of a day or part-day of jury service the summoning officer may upon an application by the employer or the self-employed person, pay a fee for the day that equals the loss.

However, in line with the Jury Regulations 2008 claims for self-employed are limited to $1000 a day unless undue hardship can be proven. This could mean there is a detrimental consequence to a financial commitment for the juror or their business. 

Employer claims

Employers other than a State Government agency may submit a claim for reimbursement for the days their employee served as a juror. Claims must be accompanied with payslips to support the employee has been paid.

The claim form will require a statutory declaration explanation and sign off by the employee to confirm they have been paid as expected.

Claims do not extend to those granted a deferral or excusal on the attendance day. Claims must be submitted and finalised within 3 months of completing jury service.

Self Employed claims

A self-employed person may submit a claim for lost personal income for the days they attend to serve. The claim must be submitted with evidence to support the financial loss.

The claim form will require a detailed explanation of the loss and how the claim amount has been calculated.

Claims may not be granted to those that seek a deferral or excusal on the attendance day. Claims must be submitted and finalised within 3 months of completing jury service.

This could mean there is a detrimental consequence to a financial commitment you have for yourself or your business. You are encouraged to contact the summoning court to discuss further.

Primary Carer

The Department of Justice will pay or reimburse reasonable out-of-pocket costs when the primary carer attends jury service on the days they do not usually require the use of Care. To be eligible to claim childcare, daycare, family care, outside school care or respite care, the facility provider must be a licenced service provider.

The primary carer is responsible for making bookings, placing, and collecting children, and knowing the business hours of the provider. The carer should enquire about the cancellation policy of the provider as they can only be reimbursed for days they have served as a juror.

It is recommended the carer makes arrangements for an alternative person to collect the children if the carer is part of a jury that is deliberating, as they may be unable to leave in time. You must provide care statements for the periods prior to and during jury service, to demonstrate your out-of-pocket expense, to support a reimbursement claim.

Claims must be submitted and finalised within 3 months of completing jury service.

Travelling allowance

A return travel allowance is payable from home to the court for days attended to serve as a juror.

The public transport fare is only paid when a person attends a Perth court. A person attending a regional court is paid per kilometre.

Payments are automatically paid into the bank account provided via the Jury WA Portal

Payments are made weekly, following jury attendance.

Taxi’s and other rideshare options such as Uber are not considered public transport, and those costs are not reimbursed.

Travel cost does not extend to and from work site locations.

Any costs associated with parking and/or infringements are the responsibility of the juror and are not reimbursed.

Business Operators

Reimbursements are only made in respect to the person who attended jury service.

You must provide evidence of lost personal income, excluding the impact on the business. Reimbursement for serving on a jury does not apply to a business loss.

If you pay yourself a wage or continued to draw an income from the business, then this can be used to support your claim.
